🤝 We highly encourage school and district administrators to share Brilliant for Educators with teachers! We also know that before doing so, it’s important for you to understand how we are protecting student and teacher data privacy.

We make every effort to meet the student privacy requirements of schools and districts, which can sometimes mean getting a legal agreement signed. This document will walk you through the steps of establishing a data privacy agreement with Brilliant.

‼️ Note that at this time, we are able to sign data privacy agreements at the large school or district-wide level. If you are an individual teacher looking to use Brilliant with your class(es) but are blocked by data privacy requirements, we strongly encourage you to suggest Brilliant to your school/district admin.

Step 1: Check to see if we have an existing Data Privacy Agreement (DPA) with your district.

If we have already signed a DPA with your district, then you don’t need to take any further action - teachers are all set to start using Brilliant with students!

How to check for an existing district-wide DPA:

1. Go to the Student Data Privacy Consortium’s website, specifically the SDPC Resource Registry (https://sdpc.a4l.org/search_national.php)

2. Click “search by district”, find your district’s name, and hit ”search” to open.

3. If your district has existing data privacy agreements, they will show up in a list. Scroll until you find “Brilliant”.

4. If your district has an existing agreement with Brilliant, it will show up in the list with a link to the signed agreement in the “Agreement type” column.

   → If you don’t see Brilliant on your district’s list of approved vendors, move onto Step 2.

Step 2: Check to see if we have an existing DPA with a district in your state.

If we have already signed a DPA with your state, then your district can piggy back off of the originating agreement by signing the General Offer of Privacy Terms and becoming a “subscribing” LEA.

• FYI - In most states, this general offer of privacy terms is known as “Exhibit E”. In some states (e.g. Montana) it is known as ‘Exhibit A”
• Some states (e.g. Massachusettes) are part of multi-state alliance, where a data privacy agreement between a vendor and a district from one state also applies across others in the alliance. If your state has not signed a DPA with us but another state in the same alliance has, then you are still covered and able to use Brilliant with students.

How to check for an existing state-wide DPA:

1. Look at the list above for your state.

2. If your state is listed, have your designated school/district tech admin review the DPA and terms previously established between Brilliant Worldwide Inc. and the originating LEA.

   → If your state is not listed, move onto Step 3.

3. If your district agrees with the terms, click the ‘General Offer of Privacy Terms’ link and sign to become a subscribing LEA.
